1. What Is the Right of Withdrawal?
Pursuant to Article 48 of the Consumer Protection Law No. 6502 and Article 9 of the Distance Contracts Regulation, in distance contracts the consumer has the right to withdraw from the contract within 14 (fourteen) days without giving any reason and without paying any penalty, starting from the date of delivery of the goods in contracts for the sale of goods, and from the date the contract is concluded in contracts for the provision of services.
2. When Does the Withdrawal Period Start?
- Sale of goods: It starts on the day the consumer, or the third party designated by the consumer, takes delivery of the goods. However, the consumer may also exercise the right of withdrawal during the period between the conclusion of the contract and the delivery of the goods.
- Orders consisting of more than one item: It starts on the day the consumer, or the third party designated by the consumer, takes delivery of the last item.
- Provision of services: It starts from the date the contract is concluded.
3. How Is the Right of Withdrawal Exercised?
It is sufficient to notify us in one of the following ways within the withdrawal period:
- Opening a return request via "My Account → My Orders → Order Detail"
- Sending a written withdrawal declaration to the store contact address ([email protected])
The burden of proving that the right of withdrawal was exercised within the period lies with the consumer. It is sufficient that the notification is directed to the SELLER within the 14-day period; it is not required that it reach the SELLER within that period.
4. Exceptions to the Right of Withdrawal (Regulation Art. 15)
The consumer has no right of withdrawal in the following contracts:
- Contracts relating to goods or services whose price depends on fluctuations in the financial markets and which are not under the SELLER's control
- Contracts relating to goods prepared in line with the consumer's requests or clearly in line with the consumer's personal needs
- Contracts relating to the delivery of goods that are liable to deteriorate quickly or whose expiry date may pass
- Contracts relating to the delivery of goods whose protective elements such as packaging, tape, seal or package have been opened after delivery and which are not suitable for return in terms of health and hygiene
- Contracts relating to goods that become mixed with other products after delivery and that cannot be separated by their nature
- Contracts relating to books, digital content and computer consumables supplied in a tangible medium, where protective elements such as packaging, tape, seal or package have been opened after the delivery of the goods
- Contracts relating to the delivery of periodicals such as newspapers and magazines, other than those supplied under a subscription agreement
- Contracts relating to accommodation, the transport of goods, car rental, the supply of food and beverages and the use of leisure time for entertainment or recreation purposes that must be carried out on a specific date or in a specific period
- Contracts relating to services performed instantly in an electronic environment or to intangible goods delivered to the consumer instantly
- Contracts relating to services whose performance has begun with the consumer's approval before the withdrawal period expires
5. Return Process and Refund
- After giving notice of withdrawal, return the product within 10 days to the SELLER or to the person authorized by the SELLER, in its original packaging, unused, undamaged and together with all of its accessories, if any.
- The SELLER refunds the total price and any documents that place the consumer under an obligation to the BUYER within 14 days of the date on which the notice of withdrawal reaches the SELLER.
- The SELLER makes the refund in a single payment, by a method appropriate to the payment instrument the BUYER used when purchasing, and without charging the BUYER any cost.
- The SELLER may postpone the refund until the notification that the goods have been sent by the BUYER reaches the SELLER, or until the product is delivered to the SELLER.
6. Return Shipping Cost
For returns made under the right of withdrawal, the shipping cost is borne by the SELLER. If a courier other than the SELLER's contracted return courier is chosen, the BUYER bears the additional cost arising from that choice.
